Radio Shaker Terms and Conditions for broadcasters
1. Welcome
Thank you for your interest to contribute to Radio Shaker's radio portal. By creating a broadcaster account and adding, editing or claiming a station, you agree to these terms. You must read, agree with and accept the Radio Shaker terms and conditions, Radio Shaker's Disclaimer and Handbook before you can create a broadcaster account.
If ever in conflict, to the extent of such conflict, the Radio Shaker Terms and conditions for broadcasters will take precedence over any other terms of this Agreement. Please read the Agreement carefully.
As used in this Agreement "you", "your", "broadcasters" or "broadcaster" means the individual or entity, having the authority to store and/or edit and/or promote the station using the Services (and/or any individual, entity or successor entity, agency or network acting on your behalf), "we", "our", "us" or "Radio Shaker" means Radio Shaker and its affiliated companies, "radio station" means the product being submitted to the Service, and the "parties" means you and Radio Shaker and its affiliated companies.
2. Broadcaster
"Broadcaster" mean the individuals or entities that are owners, connected or acting on behalf of a radio station or network, and/or have the right from the radio station itself to submit the radio station to portals or directories, such as Radio Shaker.
3. Broadcaster account and radio station submissions
Your use of the broadcaster account is subject to your creation and our approval of a broadcaster account. You have to be at least 13 years old to use our service. You may use the services only as permitted by this agreement. Any misuse of the services will not be tolerated and such misuse shall result in restriction from the site and cancellation of your broadcaster account. We have the right to refuse, remove or limit your access to the broadcaster account. At our discretion, we may add or remove functionalities or features of the broadcaster account at any time, and we may suspend or stop some or all of the broadcaster accounts.
You can only submit a radio station with a broadcaster account. You can have multiple radio stations in one broadcaster account.
The broadcaster account and radio station are individually checked and approved by Radio Shaker, if either was created or added without any agreement or right from the radio station itself, the broadcaster account and/or radio station will be removed without notice. This will happen if a contact person from the specific radio station contacts us to remove the broadcaster account or radio station submitted by you.
If a radio station is new and working, it will be approved as soon as possible and added to our listings. If the radio station does not work it is sometimes approved, but it might not show up in our listings.
4. Rights and copyrights
The broadcaster and/or radio station's owner and/or entity is the responsible entity for the copyright and other rights and laws will be followed. If we have good information about a radio station that does not follow the laws about copyright and other laws in the country it streams from or legally based, it will be removed without notice and maybe be reported to the government for illegal activity, depending on the size of the illegal activity. Radio Shaker does not have control over the content or programming of the third parties radio stations and we can't put responsible for any content on the radio stations. We aren't responsible for the behavior of any advertisers, linked websites, or other listeners and users.
5. Content
Radio Shaker provides a positive place for you and listeners to discover and share the radio you love. To keep it that way, you must abide by our Handbook. You shall not provide content in your radio station profile that violates or encourages any conduct that violates laws or regulations, including but not limited to laws or regulations applicable to your line of business and laws or regulations applicable to advertising. You agree not to use, modify, reproduce, distribute, sell, license, or otherwise use our products without our permission.
Representations and warranties with respect to your content
Radio Shaker is a portal with radio stations from all over the world and we encourage freedom of speech. To make sure our listeners feel safe and comfortable, we require everyone to agree to and follow these rules.
Different people may have different opinions on how we should enforce these rules, however, these things are rarely black and white. If there's a question about whether something is inappropriate for our community, please contact us.
You as broadcaster take full responsibility off your station's content and will not create, access, post or transmit any content that will infringe, misappropriate or violate the rights of any party or entity, including a third party's patent, copyright, trademark, trade secret, moral rights, rights of publicity, rights of privacy or other intellectual property or proprietary rights; constitute or result in defamation, libel, slander, or the violation of any applicable law or regulation (including, without limitation, restrictions on obscenity, pornography, wiretap laws or other similar restrictions on nonconsensual recording, or otherwise); or require Radio Shaker to obtain any licenses from or make any payments in any amounts to any third party throughout the world.
6. Marketing
Radio Shaker will advertise Radio Shaker's service and the radio stations existing in Radio Shaker's Service. When you submit a radio station, you agree on that we have the right to advertise the radio station with Radio Shaker's Service for free. We will not advertise on or any website connected to adult business and/or illegal businesses.
7. Update
You agree to update your radio station any time with your broadcaster account. The update will be approved right away. We encourage you to keep your radio station updated and working at all times. If however the radio station profile is misused, by adding incorrect, illegal or multiple duplicated content, your broadcaster account and radio station will be removed or blocked from future changes.
8. Removal
If your station stops broadcasting you have to update and delete the data, logo and link from Radio Shaker's website within 5 working days. If you need help or wish to remove a specific radio station you can contact us with proof of ownership and the radio station will be removed within 7 business days.
9. Liability
To the maximum extent permitted by law, you assume full responsibility for any loss that results from your use of the broadcaster account, radio station portal and the services, including any downloads from the website. We won't be liable for any indirect, punitive, special, or consequential damages under any circumstances, even if they're based on negligence or we've been advised of the possibility of those damages. We are not responsible for lost connections and/ or any errors on our website. We reserve the right to refuse service to anyone for any reason at any time.
10. General Representation and Warranty.
You represent and warrant that (i) your use of the website will be in strict accordance with the Radio Shaker Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the website will not infringe or misappropriate the intellectual property rights of any third party.
11. Indemnification.
You agree to indemnify and hold harmless Radio Shaker, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorney's fees, arising out of your use of the website, including but not limited to out of your violation this Agreement.
12. Miscellaneous.
This Agreement constitutes the entire agreement between Radio Shaker and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Radio Shaker, or by the posting by Radio Shaker of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the website will be governed by the laws of The Netherlands.
